Q.           Can I pay for my ticket without going to court?

A.            Yes, you can pay for your ticket up until 8:30 am the day of the court as long as you were not issued a Summons which is a mandatory appearance.  Please call the Court at (719) 836-2622 with questions or to make the payment.

Q.           Can I get reduced points if I pay within twenty days of being given the ticket?

A.            Yes, if you have a ticket with three or more points and pay within twenty (20) days of the issuance date, your points will be reduced by two points; and if the ticket was initially two points then it will be reduced to one point.

Q.           Do I have to pay any additional fee if I choose to attend court?

A.            Yes, there is an additional Court Costs fee of $31.00 if you remain on the Docket and attend in person.

Q.           What happens at the Court Appearance?

A.            The Court Appearance issued by the Officer is your initial appearance where the Judge provides advisement on the charges filed, possible penalties and legal rights. Following advisement, a plea is typically entered (Guilty, Not-Guilty, Nolo-Contendere, etc) or the case is set for trial as applicable.

Q.           Can I get a Plea Deal (reduction of the infraction, points, or amount owed)?

A.            It is possible to get a Plea Deal but it is at the discretion of the Officer who issued the citation.  Often the Officer may have already provided you a reduction roadside (on issuance). If that is the case, the Officer may not provide any additional reduction. There is no requirement for the Officer to provide a reduction and fines and fees are not subject to reduction unless the citation is dismissed.

Q.           Can I change my First Appearance/Advisement date?

A.            You can change the date of appearance issued by the Officer, but only once for an emergency or other legitimate reason.  Typically, you will be assigned the following month’s Court date. Please contact the Court at (719) 836-2622 if you need to discuss changing an appearance date.

Q.           Do I have to pay the assessed fines and fees on the day of the court appearance?

A.            Yes, anyone issued a citation is expected to pay all assessed fines and fees on the day of. or prior to. the issued Court appearance date. Payment plans may be extended for emergencies or other extenuating circumstances.

Q.           How does the point system in Colorado work?

A.            If you are a Colorado resident you can go to the Colorado Department of Revenue Division of Motor Vehicle  https://dmv.colorado.gov to see the details on points. 

If you are from another state you will have to refer to your state’s Department of Motor Vehicles.

Q.           Can/Should I hire an attorney?

A.            All Defendants have the right to hire an attorney to represent them in Court. In Fairplay Municipal Court, this is done at your own expense.
